The Untamed EU – terms & conditions for online sales

Welcome to The Untamed website (the “The Untamed Site” or the “Site”), operated by The Untamed of the North Aktiebolag, a company registered in Sweden under company registration number 559348-4776, with its registered office at Torstenssonsgatan 8A, 114 56 Stockholm, Sweden (“The Untamed,” “we,” “us,” or “our”).

 

Your use of the Site, its materials, and any other content offered in connection with the Site—as well as your placement of an order for products (“Products”) on the Site—constitutes your acceptance of and agreement to comply with these Terms & Conditions (“T&Cs”). “Terms and Conditions” includes all documents referenced on this page (such as our Privacy Policy, Return Policy, and Compensation Plan) and any other policies or terms referred to herein or therein, including updates, amendments, or revisions. Please read these T&Cs carefully and, if you are unhappy with any aspect, contact a customer service advisor before placing an order.

 

We reserve the right to modify these T&Cs from time to time to reflect changes to our Products or applicable law. Any changes will be posted on the Site, and if changes are significant, we will notify you by email. Your continued use of the Site after revised terms are posted indicates your acceptance of those changes. Revised terms will not apply retrospectively unless you explicitly agree. If you do not agree to these T&Cs, you are not authorized to use the Site, subscribe to a Membership, or purchase Products, and you must discontinue use immediately.

Liabilities
This section sets out the liability of you and The Untamed regarding use of the Site, services, and Products. By using the Site or purchasing Products, you agree to these terms. The Untamed provides the Site, services, and Products on an “as is” and “as available” basis and is not liable for damage or loss resulting from accessing content on the Site or using its services. You agree to defend and hold The Untamed harmless from claims or damages arising from your use of the Site or breach of these T&Cs.

 

If The Untamed fails to comply with these T&Cs, it is responsible only for reasonably foreseeable losses resulting from its breach. We are not responsible for indirect or consequential losses, even if resulting from a deliberate breach of these T&Cs. Some jurisdictions do not allow certain liability limitations, in which case some limitations may not apply.

 

In case of legal disputes, the laws in effect at the time of the relevant contract govern, and all such contracts are binding on both parties.

 

Eligibility

Purchases are binding on both parties and their respective successors and assigns. To make a purchase or use certain features on our Site, you must register and provide true, accurate, current, and complete information (including name, telephone number, and email address). If your registration information changes, you must update your online account immediately. We may change registration requirements from time to time. When ordering items, you must provide valid payment details and confirm you are the person referred to in the billing information. The purchase of Products via the Site is strictly limited to parties who can lawfully enter into and form contracts under Swedish law.

 

Pricing Policy

We take great care to ensure details, descriptions, and prices are correct at the time of publishing. Orders will only be accepted where there are no material errors in the description or price. All prices are displayed including VAT and excluding delivery charges. The total cost of your order comprises the price of the Products plus VAT at the current rate and delivery charges as set out during checkout.

 

We do not charge your card until we dispatch your order. Items in your Shopping Bag reflect the most recent price shown on the product detail page.

 

Availability

All Products are subject to availability. Validly stated prices remain in effect for as long as the Products are available or as otherwise stated on our Site. We will inform you as soon as possible if Products you have ordered are unavailable.

 

Products may vary slightly from their pictures. Images are for illustrative purposes only. While we try to display colours accurately, we cannot guarantee your device’s display accurately reflects product colours. Your Product may vary slightly from those images.

 

Ordering Errors

You may correct errors on your order until you click “Submit order” on the final page of checkout.

Acknowledgement and Acceptance of Your Order

We will acknowledge receipt of your order by email as soon as possible and provide you with an order number. If we are unable to fulfil your order after acknowledgement, we will contact you by email or phone. We will confirm acceptance of your order by sending an email confirming that the Products have been dispatched (the “Dispatch Confirmation”). A legally binding contract is formed when we send the Dispatch Confirmation (or, if a Dispatch Confirmation is not sent due to a processing error, when we dispatch the Products) (the “Contract”). For any order queries, email us quoting your order number. We may not accept your order if an item is out of stock, if a Product error is identified, or if we cannot obtain payment authorization.

 

Inspection

You should inspect Products upon receipt and check that all items specified on the delivery note are included. You will be deemed to have accepted the order unless you notify us (and return the Products in accordance with your cancellation rights or other statutory rights as referred to under Your Cancellation Rights and Your Other Statutory Rights to Return Products below).

 

Payment

Payments may be made via Visa, Mastercard, and American Express, and will be debited and cleared from your account at the point you complete your order on our Site. You confirm the card being used is yours. All cardholders are subject to validation checks and authorization by the card issuer. If your issuer refuses to authorize payment, we are not liable for any delay or non-delivery. We retain legal ownership of all Products until full payment is received, and ownership will transfer back to us if we refund any payment. Risk transfers to you upon delivery.

Transfer of Rights

We may transfer our rights and obligations under these T&Cs to another organization, and will notify you in writing if this happens; this will not affect your rights or our obligations. You may transfer your rights or obligations under these T&Cs to another person only with our written consent.

 

THE UNTAMED – TERMS & CONDITIONS FOR BRAND MEMBERS AND PRODUCTS

These Terms & Conditions (the “Terms”), the Compensation Plan (including the Code of Ethics and Rules of Conduct), and the Commercial Programs, Policies & Procedures stipulate The Untamed’s rules, principles, and members’ rights and obligations and, upon your acceptance, together constitute a binding agreement (the “Agreement” or “Member Agreement”) between The Untamed of the North Aktiebolag, company number 559348-4776, registered office Torstenssonsgatan 8A, 114 56 Stockholm, Sweden (“The Untamed,” “us”), and you (“you,” the “The Untamed Member,” the “Member”). These supersede any prior agreements, representations, or undertakings. Copies of these documents have been provided; we advise you to print or save a copy of these Terms and all other documents comprising the Agreement.

 

We reserve the right to revise the Agreement, including these Terms. The date of the latest update appears at the end. We will inform you of changes as explained in these Terms. You are responsible for keeping yourself up to date.

 

1. Definitions

Customer: any natural person, whether registered as a Member or not, who purchases The Untamed Products online and who is acting wholly or mainly outside their trade, business, craft, or profession.
Closing Period: monthly on the last day of every month.
Commercial Programs: marketing and sales programs sponsored by The Untamed from time to time.
The Untamed Products / Products: cosmetics and related accessories and certain dietary supplements offered for sale under The Untamed trademarks; the Site describes their main characteristics.
The Untamed Compensation Plan / Compensation Plan: the document comprising The Untamed’s compensation plan, part of the Brand Member Agreement.
The Untamed Code of Conduct: the document comprising The Untamed’s ethical guidelines, part of the Member Agreements.
The Untamed Trademarks: the name “The Untamed,” the The Untamed logo, and the names of products or product ranges produced, marketed, sold, or distributed by us.
Policies & Procedures: policies and procedures relevant to Compensation Plan benefits, including local variations, forming part of the Brand Member Agreement.
Prices: the prices of The Untamed Products set by The Untamed and displayed on the valid price lists at the time of order.
Territory: Europe.
Personal Data: the details provided by you upon registration as a Member and any additional information we collect or you provide from time to time.
Personal Information: information relating directly or indirectly to Customers, The Untamed Members, and other third parties whose information you collect or otherwise process in the course of your relationship with The Untamed.

2. Registration and Membership

2.1. If you purchase a Brand Membership (Brand Member Kit) during checkout on the Site, you become a Member of The Untamed.

2.2. Benefits include access to insider prices, eligibility for the Compensation Plan benefits, and participation in Commercial Programs (including training materials, promotional materials, business manuals, and starter kits). Shipping charges and other fees may apply unless included in a specific program. If any conflict arises between these Terms and other documents in the Brand Member Agreement, these Terms prevail.

2.3. You will be registered as a Brand Member after we accept your application and grant you a Brand Member number. Conditions of acceptance are stipulated in the Membership Rules section of the Rules of Conduct.

2.4. Automatic renewal: Memberships may have a minimum term and will automatically renew for additional terms of the same length unless you cancel. See the Membership Cancellation page for how to cancel. Your membership renews on the anniversary of registration and the membership fee is debited via your selected payment method.

2.5. Either you or The Untamed may terminate this Membership Agreement at any time as further stipulated in these Terms.

2.6. Membership is personal and cannot be assigned or transferred without our prior written consent.

2.7. If you are a Brand Member, you are not permitted to register a sponsored person on their behalf. Unauthorized registrations are prohibited. You will be fully liable for any claims, costs, and sums incurred due to such registration. The person registered may have claims against you under applicable privacy and civil laws. You may also, in some cases, be subject to criminal proceedings.

The Untamed may offer different Membership types with varying fees and terms. Promotional Memberships remain subject to these Terms unless otherwise stated.
Memberships Use: Memberships are intended for personal use and are non-transferable. We reserve the right to refuse any order that we determine to be excessive or beyond reasonable personal-use expectations. Sharing a membership or using someone else’s membership is not allowed. Members are responsible for keeping credentials confidential. Breaches may result in termination and/or legal action.

 

3. Membership Cancellation

3.1. Newly Purchased Membership: You may cancel within 14 days beginning the day after purchase, without reason and without penalty, by emailing contact.eu@theuntamed.com. We will acknowledge receipt upon receiving your notice. If you cancel within 14 days of registration, we will refund the full cost of the products. Any products for which a refund is requested must be returned at your cost within 21 days of cancellation. For safety and hygiene reasons, we may refuse Products that have been unsealed and are no longer in the same condition as at purchase. Refunds are made on delivery of returned Products, or immediately if Products have not yet been delivered.

3.2. Ongoing Membership: You can cancel at any time by emailing contact.eu@theuntamed.com; cancellation takes effect at the end of your current term. If your annual membership has been renewed, you may cancel within 14 days of the renewal date for a full refund.

3.3. Rejoining: If you cancel and later wish to rejoin, The Untamed may offer or decline a new membership at its sole discretion. The previously held membership type may no longer be available.

3.4. Changes to Membership Terms: If we make material changes to your membership terms, we will notify you by email. If you do not agree, you may cancel and receive a pro-rata refund for the remaining term.

 

4. Buying Products

A. Placing an Order
4.1. Place orders by completing a purchase through our Site. We do not accept orders by phone or other means.

4.2. When we accept your order, an order confirmation will be sent by email, at which point the purchase contract comes into existence.

4.3. Once your online order is placed, our local Return Policy applies.

4.4. Not all Products are available at all times; availability may vary by location and time. If a Product is out of stock when you order, we will use reasonable endeavours to inform you before finalising your order so you can change or abandon it.

4.5. The Site may occasionally be unavailable due to maintenance or technical reasons. The Untamed is not responsible for such unavailability and rejects related claims.

4.6. We do not allow you to place orders for anyone other than yourself.

 

B. Personal Orders

4.7. You may order Products for your personal self-consumption via the Site with a Member discount based on your current status. Products purchased for self-consumption may not be resold.

4.8. Your consumers will place their own orders via the Site. Purchases made by your Members will be credited to you with instant payout of retail commission to your e-wallet.

4.9. As a Brand Member, you are responsible for following our Referral Guidelines to ensure your Members are correctly credited. For questions or complaints, contact contact.eu@theuntamed.com.

 

C. Prices and Payment

4.10. Except where noted otherwise, the Prices displayed on the Site represent the full retail price at the moment the order is placed. All Prices are shown in local currency inclusive of VAT and exclusive of delivery costs, which are added before payment is finalised.

4.11. Once ordering is complete and the Dispatch Confirmation is received, the prices, products, promotions, and services for that order are not affected by subsequent changes (except in cases of obvious error). The Untamed reserves the right to change prices, products, promotions, and services at any time in its sole discretion.

4.12. Prices do not include transport, delivery, or other fees clearly indicated as additional charges during checkout and which may vary depending on the chosen delivery method. Prices may vary over time due to impositions, taxes, duties, encumbrances, or government fees, whether from new regulations or authority decisions, including as they affect Brand Member activities under the Agreement.

4.13. If there is a pricing error despite our efforts to maintain correct prices, we will seek to ensure the correct price is charged. If the correct price is lower, we will charge the lower amount. If higher, we will contact you for instructions before accepting your order. If there is an obvious and unmistakable mispricing that you could reasonably have recognised, we may cancel the order, refund your payment, and request return of the Product. Member savings shown on the Site do not include the cost of Membership unless stated; membership cost will be itemised at checkout.

4.14. Accepted payment methods are presented during checkout.

4.15. For safe online card payments, all payment information is encrypted. As The Untamed works with authorised payment service providers, card information is handled in accordance with international payment card industry data security standards.

 

C. Delivery and Transfer of Risk

4.17. Products ordered by you can only be delivered within the European Union.

4.18. The place of delivery will be as chosen by you in your order.

4.19. We will process and deliver your order as quickly as possible and no later than 30 days after confirmation. We are not liable for delivery delays caused by circumstances beyond our control.

4.20. The risk of loss and title to the Products pass to you upon delivery.

4.21. The Untamed is not responsible for non-delivery, wrong, or late delivery caused by incorrect or incomplete Personal Data provided by you.

4.22. We reserve the right to cancel an order unilaterally at any time if we reasonably suspect a breach of these Terms.

 

D. Conformity of Our Products

4.23. We warrant that The Untamed Products are manufactured in accordance with the Guidelines for Good Manufacturing Practices for cosmetic products EN ISO 22716:200.

 

5. Obligations of The Untamed Brand Member

5.1. Brand Members market and recommend Products in their own name and on their own account. If you choose to market Products, you are an independent person (self-employed/sole trader), not an agent or employee of The Untamed. You have no authority to negotiate, buy, sell, or conclude agreements in our name or on our behalf or in the name/on behalf of any company associated with The Untamed.

5.2. If you choose to market Products as a Brand Member, you must (i) comply with all applicable laws and regulations; and (ii) obtain all permits, licences, registrations, and declarations required in the Territory, including any data protection and tax registrations (see 6.7). You are solely responsible for reporting and paying taxes, duties, and fees applicable to such activity, and for ensuring all processing of Personal Information complies with applicable data protection and privacy laws (see 6.6–6.13). Your earnings as an Independent Brand Member will remain in your corresponding e-wallet for no more than 1 year (12 months rolling).

5.3. You shall uphold the image and reputation of The Untamed and not make statements or perform acts that might be detrimental to The Untamed or the Products. Operate lawfully and ethically; do not make false, misleading, or exaggerated product or earnings claims. Promote Products in accordance with The Untamed’s directions.

5.4. You acknowledge that The Untamed Trademarks, trade name and logo, online tools, and databases are The Untamed’s property, and you agree not to infringe them. All goodwill in “The Untamed” accrues to The Untamed. At our request, you will sign documentation we reasonably request to confirm this.

5.5. You agree that this Agreement and referenced materials—including the Compensation Plan, Commercial Programs, our databases (including any database containing Personal Information), and our online tools—are proprietary and subject to our intellectual property rights. You shall not use them except as authorized by this Agreement.

5.6. You are eligible to qualify for benefits of Commercial Programs available to all Brand Members, subject to their terms.

5.7. When presenting or marketing Products, you will strictly observe the Rules of Conduct and Code of Ethics.

5.8. If you supply paid promotional or training materials or provide paid training to other Brand Members, you will strictly observe the Rules of Conduct.

5.9. You shall indemnify, defend, and hold us harmless on demand from and against all actions, claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of any breach of this Agreement by you or connected to your collaboration with The Untamed.

 

Data Protection Responsibilities

5.10. As a Brand Member, you may act as an independent data controller of Personal Information you collect, record, store, use, or update. You warrant compliance with all applicable data protection and privacy laws, including Regulation (EU) 2016/679 (GDPR) and Directive 2002/58/EC (e-Privacy Directive), as implemented and amended. You are responsible for any required registrations and for complying with data protection principles.

5.11. If you sponsor a Member, collect Personal Information directly and follow our sponsorship procedures. Ensure all processing complies with applicable law.

5.12. Implement appropriate technical and organisational measures to protect Personal Information against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, or access, particularly during transmission, ensuring a security level appropriate to risk.

5.13. Notify The Untamed immediately of any personal data breach by emailing contact@theuntamed.com, explaining the nature of the incident and affected records.

5.14. If you receive a rights request under data protection laws, comply to the extent required by law and in line with The Untamed policies, procedures, or training.

5.15. Process Personal Information only in accordance with a privacy notice you supply to Members, Customers, and other Brand Members. Upon termination of your relationship with The Untamed, destroy all Personal Information in your possession or control without undue delay.

5.16. We disclaim liability for penalties, costs, fees, or expenses you incur as a result of breaches of data protection and privacy laws.

 

Marketing and Commercial Communications

5.17. You must obtain explicit consent before sending marketing communications about The Untamed Products. Keep records of consent (including date and agreed language). Each communication must explain how to unsubscribe, and you must honour opt-outs.

5.18. Our online tools may allow you to use your Members’ Personal Information for marketing, subject to: (i) you sponsored the Member (unless expressly agreed otherwise); (ii) communications concern only The Untamed Products; (iii) the message is clearly identifiable as commercial; (iv) you identify yourself and provide valid contact details and an unsubscribe method; (v) you do not contact Members who opted out; (vi) promotional offers are clearly identifiable with transparent conditions; and (vii) content complies with these Terms and applicable law.

5.19. You may not send marketing or commercial communications on behalf of The Untamed or in The Untamed’s name.

 

6. The Untamed Obligations

6.1. We will deliver Products ordered by you, subject to availability.

6.2. We expressly exclude liability for Product shortage or Products being out of stock.

6.3. You will receive any benefits/payments due in accordance with the Compensation Plan currently in force (provided directly by us or another The Untamed entity/third-party provider).

 

7. Termination

We may terminate your Brand Member Agreement with immediate effect by notice if:

you make any statement or provide Personal Data that is materially inaccurate or untrue;
a petition for your bankruptcy is presented or you are unable to pay your debts to us when due;
you commit a breach of these Terms not capable of remedy or of the Code of Ethics/Rules of Conduct; or
you commit a breach capable of remedy and fail to remedy within 14 days after written notice.

8. Complaint Handling

8.1. The Untamed complaint-handling procedure is outlined in the Terms & Conditions for e-commerce.

8.2. You may file complaints, questions, or requests by emailing contact.eu@theuntamed.com.

 

9. Website Terms

Website content is intended for private, personal, non-commercial use unless stated otherwise. We strive for accuracy but do not guarantee completeness or timeliness and accept no liability for loss arising from reliance on content (including third-party reviews, testimonials, or comments). We do not warrant the Site will be error-free; data entry errors or technical problems may occur. We reserve the right to correct inaccuracies (including pricing and availability) or take down the Site or content without notice and without liability. We may improve or change features, functionality, or content at any time. If you see information you believe is incorrect, contact Customer Services. Continued use of the Site is deemed acceptance of such changes.

 

By using the Site, you agree to our Privacy Policy, which describes how we collect, use, and protect personal information. If you provide personal information, you warrant it is accurate and that you have the right to provide it.

 

10. Intellectual Property

We are the owner of The Untamed trade and brand name, logo, trademark, and get-up. Unless expressly stated otherwise, all intellectual property rights in the Site—including copyrights, images, software, designs, text, sound, logos, artwork, look and feel, devices, branding, trademarks, product selection, articles, arrangement, product names, and other content and their coordination (collectively, “Copyright Material”)—are owned by us or our group companies and are protected by copyright laws and treaties worldwide. All rights are reserved. Any unauthorised use is strictly prohibited and may constitute infringement.

 

11. Links

We may provide links to third-party websites or resources for convenience. Such links are not endorsements. We are not responsible for the content or performance of any portion of the Internet, including other websites linked to or accessible from our Site. Please inform us of errors or inappropriate material found on linked websites.

 

12. General Provisions

12.1. Your Brand Member Agreement is governed by and construed in accordance with the laws of Sweden. If you are based in Europe, any disputes arising out of or in relation to your Brand Member Agreement are subject to the exclusive jurisdiction of the courts of Sweden.

12.2. If any provision of the Terms is held unlawful, void, or unenforceable, the invalidity of that provision shall not affect the validity of the remainder.

12.3. The failure of The Untamed to enforce any provision shall not be deemed a waiver.

12.4. As an independent Brand Member, you acknowledge and agree that we may update and amend the Agreement, including these Terms, the Commercial Programs, the Policies & Procedures, and the Compensation Plan. Any change becomes effective upon publication on www.staging-theuntamedeurope.kinsta.cloud, provided we give at least 60 days’ notice of any change in the Brand Member’s financial obligations.

12.5. Such changes are accepted by you as a condition of your continued status as a Brand Member, including continued use of the Site and ordering of Products. We may require explicit acceptance, or we will deem acceptance if you continue Brand Member activities (including ordering Products) after the change takes effect.

12.6. We may send alerts, notifications, email, direct mail, and other communications to you. By accepting these Terms, you agree that The Untamed will send any information/communications regarding your contract and/or purchase orders on a durable medium other than paper (e.g., email or another means addressed personally to you that allows storage for future reference and unchanged reproduction).

12.7. Any notice given under this Agreement by recorded delivery overnight post or first-class post to the address set out in this Agreement (or such other address notified in writing) shall result in the notice period commencing (i) the day after posting for recorded delivery overnight post, and (ii) the second business day after posting for first-class post. If notice is given by other means, the notice period starts on the day of actual receipt.

 

13. Privacy Notice

13.1. You acknowledge that you have read and understood that The Untamed may process your Personal Data in accordance with The Untamed Privacy Notice.
